I represent a woman in Nassau County on a DWI refusal to submit to a chemical test. The DA refused to plea bargain with her because she (a) refused the chemical test and (b) was traveling 86/55 and was all over the road including having an open container in the car while she was driving.
As a result of my client’s legal status, we were unable to plead to a misdemeanor because it would result in a denial of naturalization and possibly even deportation. We set the matter down for pretrial hearings and just before the officer took the stand, I pointed out to the Judge and prosecutor that the officer’s body cam video contradicted several of his statements in his sworn police paperwork. I am proud to say that my client was offered a plea reduction of a non-criminal traffic infraction. All in a day’s work!!!
